Booking Terms and Conditions
These conditions set out the basis of your contract with the Owner so please read carefully. Nothing in these Conditions affects your normal statutory rights.
In these booking conditions “we” “us”, “our” and “the Owner” refers to the owners of 27 Carlyle Place, Edinburgh.
References to “you” and “your” mean the person making the booking (“ the party leader ”) and all members of the holiday rental party.
The party leader must be authorised by all the other party members to make the booking subject to these Booking Conditions .The party leader is responsible for making all payments due to the Owner. When the Owner issues an online confirmation to you, this signifies that the Owner has entered into a contract with you which is subject to these Conditions. The Owner has the right to refuse any booking prior to the issue of your online confirmation.
We require full payment within 7 calender days from the time of booking. Payment can be made by credit or debit card via PayPal.
3. Cancellations of booking by the Owner
In the unlikely event that the accommodation is not available on the dates booked by you, we will notify the party leader as soon as is reasonably possible and use all reasonable endeavours to arrange equivalent alternative accommodation. If it is not possible to arrange alternative accommodation acceptable to you we reserve the right to refund you all monies paid by you in respect of the booking and cancel the booking. We will have no further liability to the hirer or any other party.
4. Booking Cancellation by you.
Any cancellation made by you will result in the total loss of the full amount of the booking unless the cancelled period can be relet. Any discounts made by the owner to facilitate the re-letting will be retained from any refunded amounts.
To avoid cancellation losses we suggest you arrange appropriate holiday cancellation insurance to cover the possibility of your having to cancel the Booking. For the avoidance of doubt, no such insurance is provided as part of the Booking.
5.Your Property
Arrival and Departure Time
Entry to the property is from 5pm onwards on the day of arrival. In some instances it may be possible to arrange an earlier entry time if required – please contact us to enquire. The property must be vacated by 1pm on the day of departure.
Keys
We employ a unique Key-Safe system where the keys to your property are accessed on site. You will be emailed with an individualised PIN along with directions to the property on receipt of payment. The Key-Safe system allows for late arrivals.
The number of people occupying 27 Carlyle place must not exceed 6 people in total.
The booking of 27 Carlyle Place is for the purpose of a holiday let to which Section12 (2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply. The booking agreement confers a right to occupy the accommodation for the agreed period only.
You and all members of your party agree to keep the property clean and tidy and to leave the property in a similar condition as you found it upon your arrival.
In the event of you breaching your obligations under this clause you agree to reimburse the owner upon demand for the cost of making good any damage, breakage or loss, and/or reimburse the cost of any additional cleaning required.
We shall not be liable for any loss, expense, injury or damage to you or your property arising in any manner out of the Booking except where caused by our own negligence.
6. Restrictions
No smoking on the premises
No pets permitted
No stag and/or hen parties
The owner is entitled at his/her sole and absolute discretion to refuse to hand over to you, or to repossess, the property if the owner reasonably believes that any damage is likely to be caused or has been caused by you or any members of your party, if the above mentioned restrictions are not observed or if nuisance is caused to the neighbours. These circumstances will be treated as a cancellation by you and the contract terminated without further liability to us.
You must allow the owner and any representative of the owner (including workmen) access to the property at any reasonable time during your occupation of the property. In cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time, the owner is entitled to enter the property at any time without prior notice.
Complaints
We wish for you an enjoyable and memorable holiday in Edinburgh. If however you have any cause for complaint we are anxious that remedial action is taken as soon as possible. It is essential that you contact the owner or our representative immediately if any problem arises so that it can be speedily resolved.
